Terms & Conditions of Sale – Tickets for Events and Performances

  • These terms and conditions apply to all online, over the phone and face to face sales of tickets and entries for events, performances, attractions, exhibitions and displays, either under the direct management of Wells Maltings Trust (‘WMT’) or sold as an agent by WMT on behalf of a third party.
  • The term Management refers to the appropriate and competent body that takes full responsibility for the running of the performance or event, whether Wells Maltings Trust or third-party organisation, and that respects its duty of care to the attenders and audiences of the event, performance or attraction. For events within the Maltings, this refers to Wells Maltings Trust or its authorised agents.
  • The term Venue refers to the defined and licensed space in which the performance or event takes place, whether within the Maltings complex, or in another designated and licensed space elsewhere.
  • The Management reserves the right to refuse admission to the ticket holder if in the reasonable opinion of the Management admission of the said ticket holder to the Venue might be a risk to the safety of the audience and/or the ticket holder and/or affect the enjoyment of the audience and/or the running of the performance, for example if the ticket holder appears to be under the influence of alcohol and/or drugs and/or is acting aggressively.
  • The Management reserves the right to alter the programme and times due to unforeseen circumstances or reasons beyond the control of Wells Maltings Trust or its authorised agents.
  • The time quoted on your tickets is the time that the performance/screening/event starts. Doors to the event open at least 15 minutes prior to this quoted time, giving you plenty of opportunity to take your seat/s, and our bar is always open for at least 30 minutes prior to this. For the benefit of other members of the audience, latecomers may not be permitted beyond a reasonable time after the published start time.
  • Tickets are sold on a non-returnable and non-refundable basis unless the event is cancelled or postponed by us.
  • Customers who wish to return tickets will only be offered a refund where the event is sold out and tickets can be resold. The refund will be equivalent to the face value of resold tickets less an administration charge of £1.75 per ticket. Wells Maltings Trust does not accept responsibility for failure to resell for any reason.
  • Where refund less administration charge is offered, this will be given as a credit to your Theatre Account, to be used against future ticket purchases.
  • Wells Maltings’ Friends and Patrons have guaranteed return and refund on tickets up to seven days prior to the event, regardless of our ability to resell. Details of these schemes and their other benefits are available on our website or via the box office.
  • Where an event is postponed or cancelled, a full refund will be honoured on all tickets purchased – either credited to the customer’s theatre account or refunded direct in the same payment method as the original transaction, without the deduction of any fees. No further compensation will be offered.
  • Wells Maltings Trust is registered with the Data Protection Registrar. In accordance with the Data Protection Act 1998 and the General Data Protection Regulations (GDPR) 2018, customers are asked at the point of sale whether they wish to be contacted with information of future events and whether customers wish to receive information by other third parties of relevant interest. Terms & Conditions of Vouchers for Events and Performances – May 2023

These terms and conditions apply to vouchers, either awarded free as third party prizes, or purchased, for tickets for Wells Maltings events. These terms and conditions do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice (www.adviceguide.org.uk).

Please read these terms carefully before you either purchase or redeem gift and ticket vouchers. These terms tell you who we are, how we will provide the gift vouchers to you, how you and we end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

Ticket and gift vouchers are issued by Wells Maltings, the trading name of Wells Maltings Trust (company number 07279065) Registered Office: Staithe Street, Wells-next-the-Sea NR23 1AN. Any reference in these terms to us/we/our shall mean Wells Maltings.

Our acceptance of your order for vouchers will take place when we email you to accept it,
at which point a contract will come into existence between you and us.

Where the voucher is awarded to you as part of a prize draw or raffle organised either by ourselves or a third party, this contract will be deemed to come into effect at the point at which you accept it.

Vouchers are redeemable against goods or services being offered for sale through Wells Maltings and are valid for a period as specified from the date printed on the voucher. When you redeem your voucher for goods or services, such redemption will be subject to specific terms and conditions which may apply to such goods and/or services.

Vouchers

Vouchers are supplied in GBP sterling and can be purchased subject to a minimum value of £10.00. Vouchers cannot be redeemed or exchanged for cash.

The total amount you will pay for your vouchers will be shown in your order summary before you place your order.

Payment must be made by credit or debit card. We accept all major credit and debit cards (including Visa, and MasterCard). Payment is taken in full at the time you place your order.

Prize vouchers are usually issued in terms of number of admittances for events rather than a monetary value; these vouchers have no monetary value and similarly cannot be exchanged for cash.

Receiving your vouchers

Your vouchers will be sent to the email address as specified at the time of ordering. Prize vouchers are usually awarded in printed form, but may also be electronically generated. If you have not received your email containing the vouchers after three (3) working days of placing the order, please contact us. Please check the contents of your emailed voucher immediately upon receipt. Any discrepancies must be notified to us immediately by telephoning 01328 710885.

Wells Maltings cannot be held responsible for any discrepancies not notified to us within three (3) days of delivery/receipt.

Taking care of your vouchers

The vouchers will be your responsibility from the time we deliver the vouchers to the email address you gave us, or the point at which you receive your printed voucher.

Please ensure that you keep a record of the email containing the vouchers, and keep them safe. They cannot be regenerated if they are lost.

Redeeming your vouchers

You can redeem your vouchers online by selecting the “Pay with Gift Voucher” option on the payment page or by calling Wells Maltings box office 0n 01328 710885 during opening times.
Prize vouchers will contain a code, which is for use by the recipient of the voucher only. This code will be a one-time code, and will expire once used.

Sale or transfer of vouchers

Prize vouchers are not transferable. Purchased gift vouchers can be used by others, on the understanding that you have knowingly and willingly given them the vouchers to use in good faith.

We will not accept any vouchers that have been sold to others on the open market, and will take legal recovery steps and inform the authorities where vouchers are sold on via reseller sites or other online marketplaces. This particularly applied to prize vouchers where the recipient has received them in good faith free of charge.

Refund

Our responsibility for loss or damage suffered by you

If we fail to comply with these terms, we shall only be liable to you up to the price you paid for the vouchers giving rise to your claim. We are only responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

Nothing in these terms excludes or limits in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation.

We only provide gift vouchers to consumers for personal use. If you use the site for any commercial, business or resale purposes, we will not be liable to you for any commercial or business losses such as loss of profit, loss of business, business interruption or loss of business opportunity.

We will only use your personal information as set out in our privacy policy at wellsmaltings.org.uk.

Governing Law

These terms are governed by English law and you can bring legal proceedings in respect of the vouchers in the English courts
